5. Services, Billing & Refunds
Services are provided according to the plan and pricing selected at purchase. Payment terms, billing cycles, and refund policies are specified on our pricing page and customer portal. We may suspend or terminate service for non-payment. Refunds, if any, are provided at our discretion and subject to the terms of the applicable plan.
6. Backups & Data Retention
We may offer backup and snapshot features, but you remain responsible for your own backups and data retention strategy. We are not liable for data loss except where required by an explicit service-level agreement.
7. Intellectual Property
All content on our website and the Services (excluding your content) is owned or licensed by us. You retain ownership of content you upload, but grant us a limited license to operate and provide the Services.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
9. Limitation of Liability
IN NO EVENT WILL Soft.Hosting BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES OR LOST PROFITS ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY IS LIMITED TO THE AMOUNTS YOU HAVE PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Soft.Hosting and its officers, directors, employees, and agents from any claims, losses, liabilities, damages, and expenses arising from your use of the Services or violation of these Terms.
11. Termination
Either party may terminate services in accordance with our cancellation policy. Upon termination, certain data may be deleted after a retention period. You are responsible for exporting your data before termination.
12. Governing Law
These Terms are governed by the laws of Ukraine, without regard to conflict of law rules. Any disputes will be resolved in the courts of Ukraine, unless otherwise agreed in writing.
13. Export Controls
You must comply with all applicable export control laws and regulations. You agree not to use the Services in violation of such laws.
